Clean Air Zones: Additional Exemptions and Sunset Periods pdf icon PDF 369 KB


Central Government has imposed a Ministerial Direction on the City Council to deliver a Class B charging Clean Air Zone (CAZ) to reduce levels of nitrogen dioxide to comply with at least the legal limit value in the shortest possible time.


A report was brought to Cabinet on CAZ Exemptions and Sunset Periods on 1st

December 2020. Since then a number of groups have made the case for their vehicle types to be granted an exemption or sunset period. This report discusses these.


RECOMMENDED that the Cabinet:


2.1. Approve a stop gap sunset period for non-compliant vehicles that have been unable to upgrade prior to CAZ Go Live, due to external factors outside of their control;

2.2. Approve a fee waiver for bus or coach services operating for the purposes of emergency rail or bus / coach replacement;

2.3. Approve a 2 year sunset period for the provision of domestic refuse collection vehicles, operating to deliver statutory services within Portsmouth, until end of October 2023;

2.4. Approve an exemption for up to 10 trips per year for horse transporters classed as heavy goods vehicles;

2.5. Reject the proposed exemption for motorhomes classified as private heavy goods vehicles;

2.6. Reject the proposed exemption for hybrid vehicles that do not meet the relevant euro standards for the CAZ; and

2.7. Reject the proposed exemption for pre-planned rail replacement services.

2.8. For the reasons of making the Charging Order, it is recommended that Cabinet do not consider any further requests for exemptions or sunset periods for the Portsmouth CAZ.

National Bus Strategy - Enhanced Partnership for Portsmouth (formal response)

This report seeks approval for Portsmouth City Council to establish an Enhanced Partnership, in accordance with the requirements set out in the governments National Bus Strategy - Bus Back Better.

Local Transport Plan 4


Following approval of the draft Portsmouth Transport Strategy by Cabinet in July 2020, extensive public consultation has been undertaken.  The consultation has led to the development of this new Portsmouth Local Transport Plan 4.


This report seeks approval from the Cabinet and Full Council for the adoption of the Portsmouth Local Transport Plan 4 strategy (Appendix A) and Implementation Plan (Appendix B) to form the fourth Local Transport Plan for Portsmouth for the period 2021 to 2038.

Portsmouth International Port Harbour Revision Order pdf icon PDF 242 KB


The purpose of this report is to seek approval for an application for a Harbour Revision Order (HRO) for Portsmouth International Port and the Camber. The Order will aim to modernise and consolidate the statutory harbour powers applying in relation to Portsmouth International Port and the Camber, including a new modern power of General Direction.


Part 1 Chapter 4 of the Council's Constitution governs that harbour revision order applications are reserved for the decision of Full Council. The City Solicitor has also suggested that the report goes through Cabinet as although a grey area regarding costing and hence not necessarily a key decision prima facie, this route will support transparency provided that the final decision maker is Full Council.


RECOMMENDED that Cabinet agree the following recommendations to be taken to Full Council:

(a) Approves an application being made to the Marine Management Organisation ("MMO") for a Harbour Revision Order ("HRO") for a full consolidation and modernisation of legislative powers; and

(b) Delegates authority to the Port Director in consultation with the Port's Portfolio Holder and the Harbour Master to determine the wording of the HRO based on legal advice and undertake all procedures for the submission of the HRO to the MMO.

Modern Slavery Transparency Statement pdf icon PDF 152 KB


The purpose of this report is to provide context to the council's Modern Slavery Transparency Statement, progress against the improvement plan and seek approval to publish the statement on the council's website (appendix 1).


RECOMMENDED that Cabinet approves:

1.    The Modern Slavery Transparency Statement for publication on the council's website (see appendix 1) and

2.    The programme of work set out in item 5 of this report.

3.    Full Council is asked to note the recommendations for information only.
