Councillor Jason Fazackarley was duly appointed as Chair of the Panel.

There were no declarations of interest.

RECOMMENDED that the following motion be adopted:

"Under the provisions of Section 100A of the Local Government Act 1972 as amended by the Local Government (Access to Information) Act 1985, the press and public be excluded for the consideration of the following item on the grounds that the report contains information defined as exempt in Part 1 of Schedule 12A to the Local Government Act 1972."

Agenda item 4 - Licensing Act 2003 - Application to vary a premises licence to specify an individual as designated premises supervisor - Consideration of Objection Notice

Exemption paragraph numbers 1, 2 & 3:

1. Information relating to an individual

2. Information that is likely to reveal the identity of an individual

3. Information relating to the financial or business affairs of any particular person (including the authority holding that information)

(Members are asked to hand in their confidential papers to the Democratic Services Officer at the end of the meeting)

Ben Attrill, PCC Legal Advisor pointed out that the wording enabling the sub-committee to sit in exempt session should be as stated in the Licensing Act 2003 (Hearings) Regulations 2005 (2):

"The licensing authority may exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public".

It was agreed that the motion be adopted.

The Sub-Committee is requested to determine the matter.

The application was granted.
